Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Car alert web application and related services (the "Service"), operated by SIA IO Technology ("we", "us", "our").

By creating an account, subscribing to a paid plan, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Service description

Car alert monitors publicly available car listings on SS.LV and notifies registered users when listings match their alert criteria. The Service may also display listing metadata, market statistics, and tools to contact sellers via SS.LV.

Car alert is an independent service. We are not affiliated with, endorsed by, or sponsored by SS.LV or SIA "SS". Listing data originates from third-party sources; we do not guarantee its accuracy, completeness, or availability.

3. Eligibility and account

You must be at least 16 years old and legally able to enter into a binding contract. You are responsible for keeping your login credentials confidential and for all activity under your account.

You must provide accurate information when registering. One person or legal entity may not share a single user account unless we explicitly allow it.

We may suspend or terminate accounts that violate these Terms, abuse the Service, or remain unpaid after the subscription period ends.

4. Plans, payment and billing

Paid access is offered through subscription plans described on our website. Prices, features, and limits (such as the number of alerts or notification delay) depend on the plan you choose.

Payments are processed securely by Stripe. By purchasing a plan, you also agree to Stripe's terms where applicable. We do not store full payment card details on our servers.

30-day and 90-day plans are one-time payments that extend access for the stated period. The Pro plan is a recurring monthly subscription that renews automatically until cancelled through the Stripe customer portal or by contacting us.

If payment fails or a subscription is cancelled, access may be restricted when the current paid period ends. Taxes (including VAT) may apply depending on your location and will be shown at checkout when applicable.

5. Right of withdrawal (EU consumers)

If you are a consumer in the European Union, you generally have 14 days to withdraw from a distance contract without giving a reason.

For digital services that begin immediately after purchase, you expressly request immediate access and acknowledge that you lose your right of withdrawal once access to the Service has started, to the extent permitted by applicable law.

Subscription renewals after the initial period are not subject to a new withdrawal period for the renewed term.

6. Acceptable use

You agree to use the Service only for lawful personal or internal business purposes related to searching for vehicles.

You must not: (a) scrape, resell, or redistribute listing data obtained through the Service; (b) attempt to bypass plan limits or security measures; (c) overload our systems or SS.LV; (d) use the Service to send spam or unlawful notifications; (e) impersonate another person; or (f) use the Service in a way that infringes third-party rights or applicable law.

We may throttle or block access if we detect abusive traffic or behaviour that threatens the stability of the Service or third-party sites.

7. Third-party services and content

The Service relies on third parties including SS.LV (listing data), Stripe (payments), email providers, Telegram, and your browser's push notification infrastructure. Their availability and terms are outside our control.

Links and embedded previews to SS.LV are provided for your convenience. Your use of SS.LV remains subject to SS.LV's own terms and policies.

If you configure webhooks, Telegram bots, or email addresses, you are responsible for securing those endpoints and complying with applicable communication laws.

8. Intellectual property

The Car alert name, branding, software, and original content are owned by SIA IO Technology or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service for the duration of your paid or demo access.

SS.LV listings, images, and trademarks belong to their respective owners. We claim no ownership over third-party listing content.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". We do not warrant uninterrupted operation, error-free alerts, or that you will find a suitable vehicle.

To the maximum extent permitted by law, SIA IO Technology is not liable for indirect, incidental, special, or consequential damages, including lost profits, missed purchase opportunities, or reliance on listing data.

Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, except where mandatory law provides otherwise.

10. Termination

You may stop using the Service at any time. Paid periods already started are governed by our Refund Policy.

We may suspend or terminate the Service or your account with notice where reasonable, or immediately for serious violations or legal requirements.

Upon termination, your right to access the Service ends. We may delete or anonymise account data in accordance with our Privacy Policy.

11. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance, except where applicable law requires your explicit consent.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-law rules.

EU consumers may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer arbitration board unless required by law.
